MySurgery (www.mysurgery.in) is an online health information, directory, and lead facilitation platform operated by Retaingrow Technologies LLP.

IMPORTANT — NATURE OF BUSINESS: MySurgery and Retaingrow Technologies are a MARKETING AND LEAD SOURCING COMPANY. We are NOT a hospital, clinic, diagnostic centre, or healthcare service provider of any kind.

MySurgery provides: (a) General educational information about surgical procedures, their costs, risks, and recovery (b) A public directory of doctors and hospitals sourced from publicly available information (c) A community Q&A platform for patient education (d) Marketing and lead generation services connecting patients with independent registered Healthcare Partners

All actual medical consultations, diagnoses, surgical procedures, treatments, and post-operative care are performed exclusively by independent, registered medical practitioners and hospitals ("Healthcare Partners") who are entirely separate from and not affiliated with MySurgery or Retaingrow Technologies.

By accessing or using mysurgery.in in any way — including browsing, submitting a consultation form, calling, or WhatsApp messaging — you agree to be bound by these Terms and Conditions in full.

If you do not agree with any part of these Terms, please do not use our platform or services.

These Terms constitute a legally binding agreement between you ("User" or "Patient") and Retaingrow Technologies LLP ("MySurgery", "we", "us", "our") under the laws of India including the Information Technology Act 2000, Consumer Protection Act 2019, and Digital Personal Data Protection Act 2023.

By using MySurgery, you expressly acknowledge and agree that:

(a) Retaingrow Technologies / MySurgery is a MARKETING AND LEAD FACILITATION INTERMEDIARY — not a medical or healthcare company.

(b) MySurgery's role is limited to connecting patients with independent Healthcare Partners through referral and facilitation services.

(c) MySurgery does NOT employ doctors, does NOT operate hospitals or clinics, does NOT provide medical consultations, does NOT perform surgeries or procedures, and does NOT prescribe or recommend any medical treatment.

(d) Any medical consultation, surgery, or treatment you receive is provided by an independent Healthcare Partner — not by MySurgery or Retaingrow Technologies.

(e) MySurgery may receive referral fees or commissions from Healthcare Partners for connecting patients with them. This commercial relationship does not influence our editorial content.

By submitting your name, phone number, medical condition, or any personal information on MySurgery through any form, WhatsApp, call, email, or community post, you expressly and freely consent to:

(a) Collection of your personal and medical information by Retaingrow Technologies / MySurgery for the purpose of connecting you with suitable Healthcare Partners.

(b) Sharing of your personal and medical information with one or more of MySurgery's Healthcare Partners — including hospitals, clinics, doctors, and surgical centres — as necessary to facilitate your medical consultation or treatment.

(c) Your information being shared with Healthcare Partners in your city or preferred location to identify the most suitable provider for your condition and requirements.

(d) MySurgery storing and processing your data as described in our Privacy Policy (mysurgery.in/privacy-policy).

You understand and agree that: — Healthcare Partners will receive your contact details and general medical inquiry to follow up directly with you — MySurgery will not sell your information to unrelated third parties for advertising purposes — You may withdraw consent at any time by emailing info.mysurgery@gmail.com, after which MySurgery will not facilitate further connections on your behalf

By proceeding to use MySurgery's services, you confirm that this consent is given freely, voluntarily, and with full understanding of its implications.

Doctor and hospital profiles on MySurgery are compiled from publicly available sources including hospital websites, NMC records, professional directories, and public databases.

MySurgery expressly states that:

(a) Listed doctors and hospitals are NOT employees, consultants, partners, agents, or affiliates of MySurgery or Retaingrow Technologies unless explicitly stated in writing.

(b) Listing does NOT imply any endorsement, recommendation, quality certification, or approval by MySurgery.

(c) MySurgery does NOT verify current practice status, credentials, qualifications, or any other information about listed doctors. Information may not be current or accurate.

(d) Patients must independently verify a doctor's credentials at the National Medical Commission (nmc.org.in) before proceeding with treatment.

(e) Any doctor or hospital may request removal of their profile by emailing info.mysurgery@gmail.com. Requests will be processed within 7 business days.

(f) MySurgery is not responsible for any act, omission, negligence, or misconduct by any listed doctor or hospital.

The decision to consult a doctor, undergo any medical procedure, or receive any treatment rests entirely and exclusively with you as the patient.

By using MySurgery's services, you acknowledge and agree that:

(a) You will independently verify the credentials, qualifications, registration, and current practice status of any doctor or hospital before undergoing any medical procedure.

(b) You will conduct your own due diligence regarding the suitability of any recommended doctor, hospital, or treatment for your specific medical condition.

(c) You understand all risks associated with any medical procedure and have obtained independent medical advice before proceeding.

(d) Your decision to avail the services of any Healthcare Partner referred by MySurgery is made entirely of your own free will, understanding, and volition. No coercion, inducement, or undue influence has been applied by MySurgery.

(e) You are solely responsible for evaluating the quality, safety, and appropriateness of medical services provided by any Healthcare Partner.

(f) MySurgery's referral to a Healthcare Partner is not a medical recommendation or endorsement of that provider's quality of care.

All content on MySurgery — including procedure descriptions, cost estimates, recovery timelines, FAQ answers, blog articles, community Q&A, and any communication from our care coordinators — is provided for GENERAL INFORMATIONAL PURPOSES ONLY.

This content does NOT constitute: — Medical advice or diagnosis — Recommendation for any specific treatment, procedure, or healthcare provider — A second medical opinion — A substitute for consultation with a qualified, registered medical practitioner

Always consult a qualified, registered medical practitioner before making any medical or surgical decision.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW:

(a) NO LIABILITY FOR MEDICAL OUTCOMES: Retaingrow Technologies / MySurgery shall have ABSOLUTELY NO LIABILITY for any medical outcome, surgical complication, adverse event, death, disability, injury, pain, suffering, financial loss, or any other harm — whether direct, indirect, incidental, consequential, or punitive — arising from or related to any medical consultation, procedure, treatment, or service received from any Healthcare Partner referred through MySurgery.

(b) PATIENT INDEMNIFICATION: You agree to fully indemnify, defend, and hold harmless Retaingrow Technologies, MySurgery, its directors, employees, agents, partners, and representatives from and against any and all claims, demands, suits, losses, damages, costs, and expenses (including legal fees) arising from: • Any medical treatment, surgery, or procedure you undergo at a Healthcare Partner • Any act, omission, negligence, misconduct, or malpractice by any Healthcare Partner • Any adverse outcome, complication, or harm resulting from medical treatment • Your reliance on information found on the MySurgery platform • Any breach of these Terms by you

(c) HEALTHCARE PARTNER INDEPENDENCE: All Healthcare Partners are fully independent entities. They are not employees, agents, or representatives of MySurgery or Retaingrow Technologies. MySurgery has no control over, and no responsibility for, the clinical decisions, medical practices, or outcomes of any Healthcare Partner.

(d) NO GUARANTEE OF OUTCOMES: MySurgery makes no representation or guarantee regarding the quality, success rate, safety, or outcome of any medical procedure performed by any Healthcare Partner.

(e) MAXIMUM LIABILITY: To the extent any liability attaches to MySurgery despite the above, MySurgery's total aggregate liability shall not exceed Rs 1,000 (Rupees One Thousand only).

MySurgery offers free facilitation services to patients including:

— Callback service: Care coordinators will call to understand requirements and suggest suitable Healthcare Partners — Appointment assistance: Help scheduling consultations at partner hospitals — Insurance guidance: General guidance on health insurance claims (not financial or legal advice)

Facilitation is free for patients. MySurgery may receive referral fees from Healthcare Partners.

MySurgery is NOT responsible for the quality, outcome, pricing, or availability of medical treatment at any Healthcare Partner — whether or not that partner was referred through our platform.

MySurgery operates a community Q&A forum. By posting content, you agree that:

(a) You will not post false, misleading, or harmful medical information (b) You will not impersonate a doctor or medical professional without disclosing your actual qualification (c) You will not post personal attacks, abusive content, or privacy-violating material (d) You grant MySurgery a non-exclusive, royalty-free licence to display your posted content

Community answers are NOT a substitute for professional medical advice. MySurgery may remove any content that violates these Terms without notice.

All original content on MySurgery — including procedure guides, blog articles, cost analyses, and editorial content — is the intellectual property of Retaingrow Technologies LLP and protected by Indian copyright law.

You may not reproduce, republish, or commercially use MySurgery content without written permission. Brief quotations with attribution for non-commercial purposes are permitted.

Doctor and hospital information sourced from public records is not claimed as exclusive intellectual property of MySurgery.

By using MySurgery, you agree to:

(a) Provide accurate information when submitting consultation requests (b) Not use the platform for any illegal purpose (c) Not scrape, copy, or systematically extract data from the platform (d) Not post spam, advertisements, or irrelevant content in the community forum (e) Not misrepresent your identity or professional qualifications (f) Comply with all applicable Indian laws

Our collection, use, and protection of your personal information is governed by our Privacy Policy at mysurgery.in/privacy-policy.

By using MySurgery, you consent to the collection, use, and sharing of your information as described in the Privacy Policy and in Section 4 of these Terms.

MySurgery reserves the right to modify these Terms at any time. Updated terms will be posted on this page with the revision date. Continued use of MySurgery after changes constitutes acceptance of the updated Terms.

These Terms are governed exclusively by the laws of the Republic of India. Any dispute arising from the use of MySurgery shall be subject to the exclusive jurisdiction of the courts of Delhi, India.

For grievances, please first contact our Grievance Officer at info.mysurgery@gmail.com. We will attempt to resolve disputes amicably within 30 days before any legal proceeding is initiated.

Nothing in these Terms limits your statutory rights under applicable Indian consumer protection laws.
